United States Treaty Trader Visa

The E-1 visa is designed for traders or companies engaged in the exchange of goods, services, or technology between the two countries, enabling them to manage business operations, develop commercial activities, and increase trade volume in the U.S. To qualify, the applicant must be a national of a treaty country, and a substantial portion of the trade must be conducted between the U.S. and the applicant's home country.


What is an E-1 Visa?

The E-1 visa allows individuals or employees of companies to enter the U.S. to facilitate international trade. With this visa, you can manage company operations, establish commercial connections, and execute contracts.

It is a work and trade visa that allows traders to reside legally in the U.S., manage their business, and enhance commercial ties. While it does not offer permanent residency, it provides a status that can be used for many years as long as the commercial activity continues. However, the E-1 visa is not categorized as an investment visa.


E-1 Visa Application Requirements

One of the primary conditions for the E-1 visa is that the trade must be continuous, regular, and conducted between the U.S. and the applicant's country. The following requirements must be met:

  • Treaty Country Citizenship: The applicant must be a citizen of a country that has a trade treaty with the U.S.

  • Substantial and Regular Trade: The company is expected to have a regular, continuous, and significant trade volume with the U.S.

  • Trade with the U.S.: The majority of the international trade must take place between the U.S. and the applicant's home country.

  • Active Role in Commercial Activity: The applicant must be an owner, partner, executive, or key personnel performing essential operations for the business.

  • Real and Operating Business: The enterprise must be actively engaged in trade.


How to Apply for an E-1 Visa

To initiate the application, the DS-160 form must be completed online via the U.S. non-immigrant visa system. Afterward, you must schedule an appointment for a visa interview at a U.S. Embassy or Consulate with the required supporting documents.

Required Documents

The E-1 visa application typically requires documents that prove commercial activities and company structure. Common documents requested include:

  • Valid passport

  • Online application form (DS-160) confirmation page

  • Biometric photograph

  • Company incorporation documents

  • Trade registry records showing the partnership structure

  • Invoices demonstrating trade with the U.S.

  • Import or export contracts

  • Bank statements and financial documents

  • Company tax records

  • Reports showing trade volume

  • Documents indicating the applicant’s role within the company

Note: Some applications may also require a business plan or activity report explaining the company's operations.

Who can get an E-1 Visa?

Company employees and traders who engage in active and regular commercial transactions with the U.S. are eligible. Spouses and unmarried children under the age of 21 can also accompany the visa holder. Spouses may obtain work authorization, and children can study in the U.S.

How long does the application process take?

Applications are generally finalized within 2 to 8 weeks. However, this duration can vary based on the complexity of the file, consulate workload, or requests for additional documentation.

What should be done if the application is denied?

In case of a refusal, you should review the reason provided by the consulate. You have the opportunity to reapply by completing missing or insufficient documents and providing stronger evidence of trade volume.

Can I get a Green Card with an E-1 Visa?

No. The E-1 visa is a non-immigrant visa and does not lead directly to a Green Card. However, visa holders may later become eligible for a Green Card by applying through different immigration programs.
